Terms of Use

Version 2.0 · Last revised: October 22, 2026

The website located at whowillinsure.com (and any domain that redirects to it), including the interactive map and the tools on it (the “Site”), is owned and operated by Decentralized, Inc., a Delaware corporation (“Company,” “us,” “our,” or “we”). Certain features of the Site may be subject to additional guidelines or rules posted on the Site, which are incorporated by reference into these Terms.

These Terms of Use (“Terms”) govern your use of the Site. By accessing or using the Site, or by checking a box or clicking a button that refers to these Terms when that option is presented to you, you agree to these Terms on behalf of yourself or the entity you represent, and you confirm that you have the authority to do so. If you do not agree to these Terms, please do not use the Site.

IMPORTANT — PLEASE READ SECTION 14 CAREFULLY. It contains an agreement to resolve disputes through binding individual arbitration instead of in court, and includes a waiver of class action rights and jury trial rights. You have 30 days to opt out of the arbitration agreement, as described in Section 14.

1. What the Site is: estimates, not quotes

1.1 Informational purposes only. All content, scores, and figures on the Site are estimates derived from public data. Nothing on the Site is insurance advice, an insurance quote, an offer of coverage, a binder, a rate, a recommendation of any carrier or broker, or legal or financial advice. Carrier likelihood indications are modeled estimates from public signals and may be wrong for any individual property. Premium figures are ranges derived from filed public data or are clearly labeled as illustrative.

1.2 We are not an insurer or a producer. Company is not an insurance company, agent, broker, or producer, and does not sell, solicit, or negotiate insurance. Always verify anything you read on the Site with a licensed insurance producer before making decisions.

1.3 No guarantee of coverage. We do not guarantee that any carrier or broker will offer you coverage or a quote, or that any figure on the Site is current or correct for your property. Availability and pricing depend on a full application, inspection, and each carrier’s current appetite.

2. Access to the Site

2.1 License. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your own purposes. You may cite and link to the Site, and quote short excerpts, with attribution to Who Will Insure.

2.2 Restrictions. Except as allowed in Section 2.1, you may not: (i) license, sell, rent, lease, transfer, assign, distribute, or commercially exploit the Site or its content; (ii) modify, create derivative works from, disassemble, reverse-compile, or reverse-engineer any part of the Site; (iii) scrape or bulk-harvest the Site, or access it in order to build a similar or competing product or service; or (iv) copy, reproduce, distribute, republish, download, display, post, or transmit any part of the Site. All copyright and proprietary notices on the Site must be kept intact on any copies you are permitted to make.

2.3 Changes to the Site. We may modify, suspend, or discontinue the Site (or any part of it) at any time, with or without notice. We are not liable to you or any third party for any such modification, suspension, or discontinuation.

2.4 No support obligation. We have no obligation to provide you with support or maintenance for the Site.

2.5 Ownership. All intellectual property rights in the Site’s design, code, and original text belong to Company. The underlying figures come from public records (the California Department of Insurance, the California FAIR Plan, CAL FIRE, FEMA, the U.S. Census Bureau, and the other sources credited on the Sources & Methods page); those records belong to their respective sources. These Terms do not transfer any ownership rights to you, except for the limited rights in Section 2.1. All rights not expressly granted are reserved.

2.6 Feedback and corrections. If you share feedback, suggestions, or corrections about the Site with us, you grant us a perpetual, irrevocable, worldwide, non-exclusive, fully-paid, royalty-free license to use them freely, in any manner and for any purpose, without attribution. Please do not submit anything you consider proprietary or confidential.

3. Acceptable use

You agree not to:

  • misrepresent output of the Site as an official quote or determination of insurability;
  • submit another person’s contact information without their permission;
  • use the Site to violate any law, or to harass or harm any person;
  • attempt to disrupt, probe, or gain unauthorized access to the Site or its systems.

4. Help requests and introductions

4.1 What happens to a help request. If you submit a help request through the Site, you consent to what is described in our consent notice: a person at Who Will Insure may review your request and the details you entered, will follow up with you by email, and may introduce you to a licensed California insurance broker. Introductions are made manually; there is no automated routing. Your details are emailed to Company and are not stored in a database on the Site; see the Privacy Policy.

4.2 No compensation; no effect on scores. No compensation arrangement is in place with any broker or other party for requests or introductions. If one is ever made, we will disclose it on this page before it takes effect. Introductions never affect our carrier likelihood scores, which are computed from public data only. Consent is not a condition of using the Site.

4.3 Eligibility. To submit a help request you must be at least 18 years old and a California resident, and the contact information you provide must be your own.

5. Partner inquiries and the broker pilot

Who Will Insure is running a pilot with licensed California insurance producers and agencies. Submitting the partner inquiry form is an expression of interest only. We check each producer’s license against the California Department of Insurance public lookup before introducing anyone, and terms are agreed in writing before any introduction. We do not promise any introductions, volume of requests, or outcome, and no fee, referral payment, or other compensation is owed or promised unless set out in a separate written agreement. Partners must hold a current California license for the business they conduct, and may not describe Who Will Insure’s estimates as quotes, offers of coverage, or binders.

This section also covers California real estate agents who contact us through /for-agents. The same pilot terms apply: terms are agreed in writing before any introduction, and no compensation or referral payment is offered or implied. The insurance-readiness snapshot is information. It is not insurance advice, a quote, or a statement that any carrier will write a property. Partner inquiries are for licensed business contacts acting for themselves or their agency.

6. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. It describes the personal information we collect, how we use it, and when we share it.

6.1 Processing of personal information. By using the Site, you acknowledge that Company will process your personal information in accordance with the Privacy Policy. If there is a conflict between these Terms and the Privacy Policy about personal information, the Privacy Policy controls.

6.2 Cookies and similar technologies. The Site does not set advertising or tracking cookies. For what the Site stores in your browser and which outside services your browser contacts, see the Cookies and similar technologies section of the Privacy Policy.

7. Indemnification

You agree to defend, indemnify, and hold harmless Company and its officers, employees, and agents from any claims and reasonable costs or attorneys’ fees arising out of (i) your use of the Site, (ii) your violation of these Terms, or (iii) your violation of any applicable law or regulation. We may assume control of the defense of any such claim at your expense, and you agree to cooperate with our defense. You agree not to settle any such claim without our prior written consent. We will make reasonable efforts to notify you promptly of any claim we become aware of.

8. Third-party services

8.1 Third-party services. The Site links to and integrates with third-party websites and services (“Third-Party Services”). The address checker sends the address you type directly from your browser to Esri’s ArcGIS geocoder, and the resulting coordinates to public hazard services (CAL FIRE, the U.S. Forest Service, FEMA, the California Geological Survey, the U.S. Geological Survey, and the U.S. Census Bureau). The interactive map also loads fonts from Google Fonts, a charting library from cdnjs (Cloudflare), and satellite imagery from Esri. Help requests and partner inquiries are delivered by our email provider, Resend, and the Site is hosted by Vercel. We do not control, endorse, or take responsibility for any Third-Party Services. You use them at your own risk, and the applicable third party’s own terms and privacy practices apply to that use.

8.2 FEMA data.Flood-cost figures use FEMA’s OpenFEMA data. This product uses the Federal Emergency Management Agency’s OpenFEMA API, but is not endorsed by FEMA. The Federal Government or FEMA cannot vouch for the data or analyses derived from these data after retrieval.

8.3 Brokers and other people. Your dealings with any broker, agent, or other person you meet through the Site, including through an introduction, are solely between you and them. We are not responsible for their advice, products, or conduct.

8.4 Release. To the fullest extent permitted by law, you release Company and its officers, employees, agents, successors, and assigns from all claims, demands, and damages of any kind arising out of or related to Third-Party Services or your dealings with brokers, agents, or other people you meet through the Site. If you are a California resident, you waive California Civil Code Section 1542, which provides: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

9. Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. PUBLIC DATA CHANGES, AND CARRIER APPETITES CHANGE FASTER; WE DO NOT WARRANT THAT ANY FIGURE ON THE SITE IS CURRENT OR CORRECT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR HARMFUL CODE. WHERE APPLICABLE LAW REQUIRES WARRANTIES, THEY ARE LIMITED TO 90 DAYS FROM YOUR FIRST USE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) COMPANY AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY LOST PROFITS, LOST DATA, COSTS OF SUBSTITUTE PRODUCTS, OR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE SITE, INCLUDING ANY LOSS ARISING FROM RELIANCE ON THE SITE’S ESTIMATES, FROM COVERAGE OR QUOTE OUTCOMES, OR FROM DECISIONS ABOUT BUYING, SELLING, INSURING, OR NOT INSURING PROPERTY; AND (B) OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS IS CAPPED AT THE GREATER OF (i) $50 USD AND (ii) THE AMOUNT PAID TO COMPANY BY YOU UNDER THESE TERMS IN THE SIX MONTHS PRIOR TO THE INCIDENT GIVING RISE TO THE CLAIM. THE SITE IS FREE. THE EXISTENCE OF MULTIPLE CLAIMS DOES NOT INCREASE THIS CAP.

11. Term and termination

These Terms remain in effect while you use the Site. We may suspend or terminate your access at any time and for any reason, including if we believe you have violated these Terms. We are not liable to you for any such termination. Upon termination, Sections 1, 2.2 through 2.6, and 6 through 14 will survive.

12. State-specific legal notices

The provisions in this Section 12 apply only to users to the extent they are subject to the laws of the states identified below. If a provision in this section conflicts with another provision of these Terms, the state-specific provision controls for users subject to that state’s laws.

12.1 California. Under California Civil Code Section 1789.3, California users of the Site are entitled to the following consumer rights notice. See our Privacy Policy for how to exercise them.

12.3 Connecticut. See our Privacy Policy.

12.5 Nevada. If you are a Nevada resident, you have the right under Nevada Revised Statutes Chapter 603A to direct us not to sell certain information we have collected or will collect about you. We do not sell personal information; to submit a request anyway, email contact@whowillinsure.com.

12.6 Other states. Residents of other states with comprehensive consumer privacy laws may have similar rights. The Privacy Policy explains how to exercise them, and we honor requests from residents of every state on the same terms.

13. General

13.1 Changes to Terms. We may update these Terms from time to time. If we make material changes, we will post a prominent notice on the Site and update the “Last revised” date above. Your continued use of the Site after notice of changes means you accept the updated Terms.

13.2 Governing law. These Terms and any dispute arising out of or related to these Terms or the Site are governed by the laws of the State of California, without regard to its conflict-of-law principles, except that the Federal Arbitration Act governs Section 14. For any claim or dispute not subject to the arbitration provisions in Section 14, you and Company consent to the exclusive jurisdiction and venue of the state and federal courts located in New Castle County, Delaware. Notwithstanding the foregoing: (a) either party may bring an action in any court of competent jurisdiction for injunctive or other equitable relief to protect its intellectual property rights; and (b) either party may bring an individual action in small claims court for claims within that court’s jurisdictional limits.

13.3 Service interruptions. We are not liable for any delay or failure caused by events outside our reasonable control, including outages at our hosting, email, or public-data providers.

13.4 Export. You agree not to export, re-export, or transfer any technical data acquired from the Site in violation of U.S. export control laws or applicable regulations in other countries.

13.5 Electronic communications. By using the Site, you consent to receiving communications from us electronically, by email or by notices posted on the Site. These electronic communications satisfy any legal requirement for written notice.

13.6 Accessibility. Company is committed to making the Site accessible to all users, including individuals with disabilities. We aim to conform to the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA. If you have difficulty accessing or navigating the Site, or have suggestions for improving accessibility, contact us at contact@whowillinsure.com. We will make reasonable efforts to address accessibility concerns promptly.

13.7 Entire agreement. These Terms, together with the Privacy Policy and any other policies or guidelines referenced in them, are the entire agreement between you and Company regarding your use of the Site. If any provision of these Terms is found to be invalid or unenforceable, it will be modified to the minimum extent necessary to be valid, and the remaining provisions will continue in effect. Our failure to enforce any provision is not a waiver of that provision. The word “including” means “including without limitation.” You may not assign these Terms without our prior written consent; we may assign them freely. These Terms bind any permitted assignees.

13.8 Copyright and trademarks.Copyright © 2026 Decentralized, Inc. All rights reserved. All trademarks, logos, and service marks displayed on the Site are owned by Company or third parties. You may not use any of them without prior written consent from the owner. Carrier names are used only to identify the companies described.

14. Dispute resolution

Please read this section carefully. It affects your legal rights, including your right to sue in court and your right to a jury trial.

14.1 Applicability. Except as described below, you and Company agree to resolve all disputes arising out of or relating to the Site or these Terms through binding individual arbitration, not in court. Exceptions: (i) claims that qualify for small claims court, brought on an individual basis; (ii) requests for equitable relief related to intellectual property (such as trademarks, trade secrets, or copyrights) or to stop unauthorized access to the Site; and (iii) requests for public injunctive relief, to the extent California law does not allow that right to be waived, which will be decided by a court after any individual claims are arbitrated. This arbitration agreement applies to all claims, including those that arose before you agreed to these Terms.

14.2 Try to resolve it first. Before starting arbitration, the parties agree to try to resolve the dispute informally. The party raising the dispute must send written notice (an “Informal Notice”) to the other party. Within 45 days of receiving an Informal Notice, the parties will meet by phone or video in good faith to try to work things out. Company’s notice address: contact@whowillinsure.com, or Decentralized, Inc., c/o Legalinc Corporate Services, Inc., 651 N Broad St, Suite 201, Middletown, DE 19709. If the informal process doesn’t resolve the dispute within 60 days, either party may start arbitration.

14.3 Arbitration rules.Arbitrations will be administered by JAMS (www.jamsadr.com). Claims under $250,000 (excluding fees and interest) will use JAMS’ Streamlined Arbitration Rules; larger claims will use JAMS’ Comprehensive Arbitration Rules. For claims you bring as a consumer, JAMS’ Consumer Minimum Standards also apply: you will pay no more than the JAMS consumer filing fee, and Company will pay the remaining JAMS fees and arbitrator compensation. Unless the parties agree otherwise, the arbitration will take place in the county where you live, or by video. All arbitration materials and documents are confidential.

14.4 Arbitration request. The arbitration request must include: (i) your name and contact information; (ii) a description of the claims and supporting facts; (iii) the relief you are seeking and a good-faith damages estimate; (iv) confirmation that you completed the informal resolution process; and (v) proof of any required filing fee payment.

14.5 Authority of arbitrator. The arbitrator has authority to resolve all arbitrable disputes, including questions about the scope and enforceability of this arbitration agreement, except that courts (not arbitrators) will decide: (i) challenges to the class action waiver below; (ii) disputes about arbitration fees; (iii) whether a condition precedent to arbitration has been satisfied; and (iv) which version of this agreement applies. The arbitrator may award the same relief as a court, but on an individual basis only. The arbitrator’s award is final and binding, and judgment may be entered in any court with jurisdiction.

14.6 Waiver of jury trial. BY AGREEING TO ARBITRATION, YOU AND COMPANY WAIVE THE RIGHT TO A TRIAL BY JUDGE OR JURY FOR ALL COVERED CLAIMS.

14.7 Waiver of class actions. ALL DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS. NEITHER YOU NOR COMPANY MAY BRING CLAIMS AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, REPRESENTATIVE, OR COLLECTIVE PROCEEDING. The arbitrator may only award relief on an individual basis. If a court finds this class action waiver unenforceable as to a specific claim, that claim may be litigated in court as described in Section 13.2; all other claims remain subject to arbitration.

14.8 Attorneys’ fees. Each party bears its own attorneys’ fees unless the arbitrator finds a claim was frivolous or brought for an improper purpose, or applicable law provides otherwise.

14.9 Batch arbitration. If 100 or more substantially similar arbitration demands are filed against Company within a 30-day period by the same law firm or coordinated group, JAMS will batch them into groups of 100 and appoint one arbitrator per batch, with one set of fees per batch.

14.10 Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to contact@whowillinsure.com or to Decentralized, Inc., c/o Legalinc Corporate Services, Inc., 651 N Broad St, Suite 201, Middletown, DE 19709. Your notice must include your name, your address, and a clear statement that you wish to opt out. Opting out does not affect any other part of these Terms.

14.11 Changes. If we change this Section 14, the change will not apply to a dispute that either party had already given notice of before the change.

14.12 Severability. If any part of this arbitration agreement is found invalid, it will be modified to the minimum extent necessary to make it enforceable; the rest of the agreement remains in effect.
